By using Eventya you agree to these terms. You own your content. We own the platform. A new project gets a 30-day free trial; after it, the project needs an active subscription, or it is suspended until it has one. You can cancel anytime. We can suspend accounts that violate these terms. For the full legal detail, read on.
1. Agreement and Parties
These Terms of Service (“Terms”) govern your use of the Eventya platform, operated by Eventya CO SRL, a company incorporated in Romania (CUI RO31611012, J32/408/2013). By creating an account, you agree to be bound by these Terms.
2. The Service
Eventya is a Software-as-a-Service (SaaS) Destination Management System (DMS) for Destination Management Organisations (DMOs). The service includes website hosting, CMS, mobile apps, AI Agent, AI Assistant, Media Gallery, Community and Helpdesk.
Each destination works in its own project. What a project can use depends on its package (Helpdesk, Web, Mobile or Enterprise) and on the modules added to it (Helpdesk Pro, AI Agent, Community, Media Gallery).
3. Accounts and Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your credentials
- You must be at least 18 years old to create an account
- You sign in with a code sent to your email address, or with Google or Apple. One email address is one account: signing in with Google or Apple opens the account with the address the provider confirms, or creates it
- One account may own or join several projects, one for each destination
4. Subscriptions, Pricing and Payment
4.1 Free trial
A project you create on eventya.net gets a free trial of 30 days, with the features of the Enterprise package, except a WhatsApp number. No card is needed, and the trial ends on its own, with nothing charged.
4.2 Subscriptions
After the trial, a project needs an active subscription. You choose one package (Helpdesk, Web, Mobile or Enterprise) and the modules your package allows. Every package includes the whole team, with no per-user fee. Current prices are in the Prices section of our website.
A subscription is billed monthly or yearly. Paying yearly costs 10% less. Enterprise is available only through our offer and a contract.
4.3 Prices and payment
All prices are in EUR and include VAT: the price shown is the price you pay. You pay either by card, processed by Stripe, or by invoice, under a contract based on our offer. A subscription paid by card changes only by card, and a contract changes only through a new offer. A price agreed in a contract takes precedence over the published prices.
4.4 Changes to a card subscription
A higher package, an added module or a switch from monthly to yearly billing takes effect at once, and you pay the difference for the rest of the current period. A lower package, a removed module or a switch from yearly to monthly billing takes effect at the end of the current period.
4.5 Cancellation and refunds
The project's owner can cancel a card subscription at any time from the project's Subscription page. The subscription ends at the end of the period already paid, and it can be resumed until then. A contract ends as the contract states. No partial refunds are provided for unused time within a billing period.
4.6 Failed payments
If a card renewal fails, we tell the project's owners by email, and they can pay the open invoice from the Subscription page. The project stays open for 7 days from the first failed payment. If the invoice is still unpaid after that, the project is suspended until it is paid.
4.7 End of a trial or subscription
For a trial or a contract, we email the project's owners 7 days and 1 day before it ends. When a trial or a subscription ends without being renewed, the project is suspended:
- its website, mobile apps, API and MCP access stop serving content and show that the project is unavailable
- its team sees only the page for continuing the subscription
- emails sent to its Helpdesk are rejected and WhatsApp messages are not received, so they are lost
We keep the project's content while it is suspended. Everything is available again as soon as the project has an active subscription.
5. Your Content
You retain full ownership of all content you upload to Eventya. By uploading content, you grant Eventya a limited, non-exclusive licence to host, display and distribute that content solely for the purpose of operating the service.
You are responsible for ensuring your content does not infringe third-party intellectual property rights and does not contain unlawful material.
You may export your content at any time via JSON. Upon termination, your content remains accessible for 30 days for export purposes.
6. Intellectual Property
The Eventya platform, including its code, design, documentation and brand, is owned by Eventya CO SRL. You may not reverse-engineer, copy, or redistribute any part of the platform.
7. Acceptable Use
You agree not to:
- Use the service for spam, malware distribution, or phishing
- Attempt unauthorised access to other accounts or systems
- Scrape, crawl or programmatically extract data without permission
- Use the service for illegal purposes
- Impersonate other persons or organisations
- Deliberately disrupt the service or other users' experience
- Resell the service without written agreement
8. Data Protection
Our Privacy Policy and Data Processing Agreement are incorporated by reference into these Terms. They govern how we process personal data.
9. Availability and Support
We target 99.5% monthly uptime for paid subscriptions. We provide support via email with a target response time of 4 business hours for critical issues and 1 business day for general enquiries. Planned maintenance is announced 48 hours in advance.
10. Limitation of Liability
Our total liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. We are not liable for events outside our reasonable control (force majeure). Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud.
11. Warranties and Disclaimers
The service is provided “as is” and “as available.” We make commercially reasonable efforts to ensure reliability but do not guarantee uninterrupted or error-free operation.
12. Termination
- By you: Cancel a card subscription anytime from the project's Subscription page; a contract ends as the contract states
- By Eventya: With 30 days written notice
- For breach: Either party may terminate for material breach with 14 days notice to cure
- Immediate: For serious breach (illegal use, security threats, non-payment beyond 30 days)
13. Governing Law and Disputes
These Terms are governed by Romanian law and applicable EU law. In the event of a dispute, the parties agree to attempt good-faith negotiation for 30 days before initiating legal proceedings. Disputes shall be resolved by the courts of Bucharest, Romania.
14. Changes to These Terms
We will notify you by email at least 30 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
15. Miscellaneous
These Terms, together with the Privacy Policy, Cookie Policy, and DPA, constitute the entire agreement. If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a right does not constitute a waiver. Notices should be sent to legal@eventya.net.
